Vivaqui
1. Scope and parties
These Terms govern your use of the Vivaqui platform at vivaqui.app and any associated applications ("Platform"), operated under the Vivaqui brand ("Vivaqui", "we", "us").
They apply to all registered users: individuals seeking services ("Seekers") and individuals or entities offering services ("Providers"), collectively "Users". By creating an account or using the Platform you agree to these Terms. Users must be at least 18 years old.
2. Role of Vivaqui
Vivaqui is a digital marketplace. We provide technology that lets Seekers and Providers find each other, communicate, book services, and process payments. We are not a party to the service agreement between Seeker and Provider, and we are not an employer, agent, or contractor of any Provider. We do not guarantee the quality, safety, or legality of any listing or that any transaction will be completed. Providers are independent providers solely responsible for their services and for compliance with applicable law (taxes, insurance, licensing).
3. Accounts
You must provide accurate information and keep it up to date. You are responsible for all activity under your account. If you suspect unauthorized access, contact us at hello@vivaqui.app. Accounts are personal and non-transferable. We may suspend or close any account that breaches these Terms or poses a risk to the Platform or its Users.
4. Provider obligations
Providers must deliver services as described, on time, and to a professional standard. Listings must be accurate. Providers are responsible for any required licenses, insurance, and tax obligations. Providers may not redirect payment outside the Platform for bookings that originate on it.
5. Seeker obligations
Seekers must provide accurate booking information and treat Providers respectfully, giving reasonable access and cooperation needed to deliver the service.
6. Bookings
A booking is initiated by a Seeker's request and confirmed once the Provider accepts and payment is complete (Section 7). Providers may decline requests before acceptance. Once confirmed, the booking is a direct agreement between Seeker and Provider; Vivaqui facilitates but is not party to it. The Service Request feature lets Seekers post a need and receive proposals; a binding booking only exists once a proposal is accepted and paid. Both parties must honour confirmed bookings.
7. Pricing, fees, and payments
Providers set the listed booking price for their services. The Seeker is charged the listed booking price shown at checkout. Vivaqui currently adds no separate seeker booking fee to that listed price. Vivaqui deducts its standard 15% provider commission from the provider side of the booking, and an eligible active commission promotion may temporarily reduce that provider commission. All prices are in EUR inclusive of applicable VAT. Payments are processed by Stripe; by paying you also accept Stripe's Terms of Service. Vivaqui does not store card data. Providers receive payouts via Stripe Connect subject to Stripe's schedule, identity verification requirements, and applicable payment-processing treatment.
8. Cancellations and refunds
Seeker cancellation: terms depend on timing and are shown at booking.
Provider cancellation: if a Provider cancels a confirmed booking, the Seeker receives a full refund of the amount paid at checkout.
Platform refund: following a resolved dispute, Vivaqui may issue a full refund of the amount paid at checkout at its discretion.
Refunds are processed to the original payment method; timing depends on your bank.
9. Right of withdrawal (consumer Seekers)
If you are a consumer, you have a 14-day right of withdrawal from a distance contract without giving reasons. If you request that the service begins within that 14-day period and it is fully performed, you lose the right of withdrawal on completion. By confirming a booking whose service date falls within 14 days of confirmation, you expressly consent to immediate performance and acknowledge that your right of withdrawal will be extinguished on completion. To exercise withdrawal before performance, contact hello@vivaqui.app.
This right does not apply to Seekers acting in a business capacity.
10. Reviews
After a completed booking, both parties may leave a review. Reviews must be honest and based on actual experience. Vivaqui does not incentivize or manipulate reviews and does not publish reviews from parties without a verified booking. Reviews containing false statements, hate speech, personal attacks, or private information may be removed.
11. Prohibited conduct
Users must not: post false or misleading listings; use the Platform for unlawful activity; harass or discriminate against other Users; circumvent Platform fees; scrape or reproduce Platform content without permission; interfere with Platform operation; or create multiple accounts or impersonate others. Violations may result in immediate account suspension or termination.
12. Intellectual property
The Vivaqui brand, trademarks, and Platform design belong to Vivaqui and may not be used without prior written consent. Providers retain ownership of their uploaded content and grant Vivaqui a non-exclusive, royalty-free, worldwide licence to display and use that content to operate and promote the Platform.
13. Limitation of liability
To the extent permitted by law, Vivaqui's total liability for any claim arising from these Terms or use of the Platform shall not exceed the platform fees paid by that User in the 12 months before the claim. Vivaqui is not liable for: the quality, safety, or fitness for purpose of any Provider's service; loss of revenue, loss of data, or indirect losses; or failures outside Vivaqui's reasonable control. Nothing limits liability for death or personal injury caused by Vivaqui's negligence, or any other liability that cannot be excluded by law. Consumer statutory rights are not affected.
14. Indemnification
You agree to indemnify Vivaqui from any claims, losses, or costs (including reasonable legal fees) arising from your use of the Platform, breach of these Terms, or infringement of third-party rights.
15. Data protection
Personal data is processed as described in our Privacy Policy at vivaqui.app/legal/privacy. By using the Platform you confirm you have read it.
16. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-Platform notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not accept, close your account and stop using the Platform.
17. Termination
These Terms apply for as long as you have an active account. You may close your account at any time via account settings or by emailing hello@vivaqui.app. We may suspend or terminate accounts for breach of these Terms or risk to the Platform. On termination, your right to use the Platform ceases; provisions that by nature survive (liability, IP, governing law) remain in effect.
18. Dispute resolution
We encourage Users to resolve disputes directly through the Platform's messaging and support tools. EU consumers may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr (contact: hello@vivaqui.app). Vivaqui is not obliged to participate in consumer arbitration proceedings.
19. Governing law and jurisdiction
These Terms are governed by the laws of Bulgaria, without prejudice to mandatory consumer protection laws of your country of residence. For disputes with business Users, the courts of Bulgaria have exclusive jurisdiction. For disputes with consumers, the statutory rules on jurisdiction of your country of residence apply.
20. Miscellaneous
If any provision is invalid, the remaining provisions continue in full force. These Terms together with our Privacy Policy constitute the entire agreement between you and Vivaqui. Vivaqui may assign its rights to a successor entity in a merger or acquisition; you may not assign your rights without our consent.
